You acknowledge and agree that Immigrant Hope shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Minnesota, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Digital Millennium Copyright Act (“DMCA”)

Immigrant Hope respects the intellectual property rights of others. Per the DMCA, Immigrant Hope will respond expeditiously to claims of copyright infringement on the Site if submitted to Immigrant Hope’s Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, Immigrant Hope will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright protected content.

If you believe that your intellectual property rights have been violated by Immigrant Hope or by a third party who has uploaded materials to our website, please provide the following information to the designated Copyright Agent listed below:

  1. A description of the copyrighted work or other intellectual property that you claim has been infringed;
  2. A description of where the material that you claim is infringing is located on the Site;
  3. An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not Immigrant Hope, can contact you;
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;
  5. A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner’s behalf;
  6. Your electronic or physical signature.

Immigrant Hope may request additional information before removing any allegedly infringing material. In the event Immigrant Hope removes the allegedly infringing materials, Immigrant Hope will immediately notify the person responsible for posting such materials that Immigrant Hope removed or disabled access to the materials. Immigrant Hope may also provide the responsible person with your email address so that the person may respond to your allegations.
